Terms of Service

These terms are an agreement between you and [Company name, legal form and registration number], [address], Denmark ("we", "us"), the operator of Companion ("the service"). By creating an account you accept them.

1. What Companion is

Companion is a private, AI-driven companion: a character with a memory, a face and a voice that you talk to in writing or by voice, and that can send you generated pictures and short generated videos. Everything the character says, shows or sends is generated by software. There is no human on the other side, and nothing the character says is advice of any kind.

2. Who may use it

You must be at least 21 years old. You confirm this when you create your account. We may ask for proof and close accounts where we cannot confirm it.
During the beta the service is available by invitation only. An invite is personal and may not be sold or passed on without our consent.
One account per person. You are responsible for what happens under your account and for keeping your password to yourself.

3. Content limits

Companion is a romantic companion, not an adult content service. The character is always an adult, the tone stays at what we call "soft": affectionate, flirtatious, suggestive at most. The service does not produce sexually explicit text, pictures or video, and it will not depict nudity or sexual acts. These limits are enforced by the software and cannot be switched off.

You agree not to try to obtain, and not to ask the character for:

sexually explicit content of any kind;
any depiction of a person under 18, or of a character presented as younger than an adult;
pictures or videos of a real, identifiable person, including yourself, other than the reference details you knowingly provide for your own character's appearance;
content that is violent, hateful, harassing, or illegal in Denmark or in your country;
anything that circumvents the safety measures of the service.

Requests that hit these limits are refused. Repeated attempts are logged and may lead to the account being closed.

4. Your content and generated content

What you write stays yours. You grant us the right to process it in order to run the service for you.
Pictures, videos and text generated for you may be used privately. You may not sell them or present them as pictures of a real person.
We do not use your conversations to train AI models.

5. Plans and limits

Every account has a plan with limits on messages per day and on pictures and video seconds per month. The limits of your plan are shown in the app. During the beta the service is free of charge for invited members; we may introduce paid plans later, and we will tell you before anything costs money.

6. Beta, availability, changes

This is a beta. The service may be slow, unavailable, or change without notice, and generated content may be wrong, odd or unexpected. We may change or end the service, and we will give you a reasonable chance to export your data if we end it.

7. Ending the agreement

You can delete your account at any time in the app. Your data is deleted as described in the privacy policy.
We may suspend or close an account that breaks these terms, or if we are legally required to.

8. Liability

The service is provided as it is. To the extent permitted by law we are not liable for indirect losses, lost data, or for decisions you take based on what the character says. Nothing in these terms limits liability that cannot be limited under Danish law, including for intent or gross negligence.

9. Law and disputes

Danish law applies. Disputes are brought before the courts of Denmark. Consumers in the EU keep the rights they have under the law of their country of residence, and may use the European online dispute resolution platform.

10. Changes to these terms

We may update these terms. Material changes are announced in the app at least 14 days before they apply. If you keep using the service after that, the new terms apply.
